Gibbons Names Robert Malone Chair of the Firm’s Financial Restructuring & Creditors’ Rights Department

Robert K. Malone, a well-known and respected bankruptcy and insolvency law practitioner, has joined Gibbons P.C. as Chair of the firm’s highly regarded Financial Restructuring & Creditors’ Rights Department.

“Gibbons already has the versatility of having represented all major constituencies in chapter 11 cases and the distinction of having been involved in groundbreaking bankruptcy decisions in the Third Circuit Court of Appeals,” says Patrick C. Dunican Jr., Chairman and Managing Director of the firm. “With a growing regional and national bankruptcy practice, particularly in the Southern District of New York and the District of Delaware – the country’s two preeminent corporate bankruptcy venues – we are excited to see where Bob’s leadership takes us.”

Mr. Malone is the latest in a long line of esteemed leaders of the Gibbons Financial Restructuring & Creditors’ Rights practice, beginning with the firm’s founder, Andrew B. Crummy, a prominent financial restructuring attorney in the first half of the 20th century and up to his retirement. Subsequent practice leaders have been among the most acclaimed bankruptcy practitioners in the state of New Jersey, including Frank J. Vecchione, a Fellow of both the American College of Bankruptcy and the American Bar Foundation, who led the team in such matters as In re Marvel Entertainment Group, Inc., a hotly contested battle over corporate governance between Carl Icahn and Ronald Perelman. His successor, Karen A. Giannelli – the first female president of the New Jersey Chapter of Turnaround Management Association, first woman elected Chair of the New Jersey State Bar Association’s Bankruptcy Law Section, and first woman attorney from New Jersey to be elected into the American College of Bankruptcy – served as co-counsel to the Offcial Committee of Unsecured Creditors in the bankruptcy cases of Trump Entertainment Resorts, Inc. and affliated chapter 11 debtors.

Mr. Malone practices in all areas of bankruptcy and insolvency law, with a focus on sophisticated corporate reorganisations, out-of-court restructurings, and bankruptcy-related litigation. His particular experience in the area of corporate reorganisations includes representation of offcial committees of unsecured creditors and bondholders, debtors-in-possession, chapter 11 and 7 trustees, secured creditors and lenders, indenture trustees, asset purchasers, lessors, and other significant creditors. He earned his JD from Seton Hall University School of Law and his BA from The Catholic University of America. He is admitted to practice in the state of New Jersey; the US District Courts for the District of New Jersey, Southern District of New York, and Western District of New York; and the US Court of Appeals for the Third Circuit.
